Terms and Conditions for Booking-Admin.com
In these booking conditions, ‘you’ and ‘your’ and ‘guest’ or ‘guests’ means all people named on the booking form (including anyone who is added or replaced at a later date).’Agent’ means Gael Holiday Homes and/or Booking-Admin.com who administer bookings of Accommodation on behalf of the owners of Braevellie Apartments. ‘owner’ and ‘owners’ means the owner of Braevellie Apartments. ‘Property’, ‘Properties’ and ‘Accommodation’ means Braevellie Apartment(s) and it’s grounds. ‘Booking’ means the rental period that has been booked.
The contract is between you and the owner of the property and is subject to the following conditions. (Nothing in these conditions affects your statutory rights).
These properties must not be used for party purposes without prior written agreement. The rental of the accommodation is for holiday purposes only and no work or business is to be conducted from the property unless agreed by the agent or owner prior to booking.
Sorry, but we cannot accept Hen or Stag parties.
You agree that the property is let to you to be used for the purposes of a holiday only and you so accept that the letting is a holiday let to which paragraph 6 of schedule 1 of the Private Housing (Tenancies) (Scotland) Act 2016 applies namely ‘A tenancy cannot be a private residential tenancy if the purpose of it is to confer on the tenant the right to occupy the let property for a holiday.’
PETS
Sorry, but we do not accept pets in either apartment.
SMOKING
Both apartments operate a no smoking policy. If you wish to smoke, please do so outside and dispose of extinguished items in the bucket provided. Smoking inside the properties is a breach of our property insurance terms.
PERSONAL DETAILS
Information you provide may be forwarded to the owner of the property who may contact you with regard to your forthcoming booking.
YOUR APARTMENT
Your apartment will be available from 1600hrs on the day of your arrival and it must be vacated by 1000hrs on the day of your departure. Entry details, key collection information and/or meet and greet arrangements for your apartment will be sent to you 5 days prior to arrival as part of your payment confirmation. Please ensure you have these details prior to your arrival as if you arrive without making arrangements in advance you may not be able to gain entry to the Apartment.
RESPONSIBILITIES OF THE GUEST
The guest undertakes to keep the accommodation and all furniture, fixtures and fittings in the same state of repair and condition as at the start of the rental and to leave the accommodation clean and tidy upon departure. The number of persons using the accommodation at any time must not exceed the maximum number as stated on the booking form or on the website. There is no smoking allowed inside any property booked on our or any partners website/s. The guest is not to cause an annoyance or become a nuisance to occupants of adjoining premises during their stay. The rental of the accommodation is for holiday purposes only and no work or business is to be conducted from the property unless agreed by the agent or owner prior to booking.
If there is a breach in these conditions the agent reserves the right to request credit card details of all guests paying by bank transfer or charge the guest’s card a fee to cover all costs for any extra labour time needed to clean and prepare the property for the following incoming guests or to right any damage to the Property or contents. A charge may also be made for breach of no smoking policy. You will be informed of any charges in advance.
In the event of breach of these terms and conditions the guest/s may be required to leave the Property during the period of the Booking without compensation.
YOUR BOOKING
You must be 21 years or over when you book the apartment. The agent, owner or their representative, has the right to refuse you entry to the property if you are not over 21 years old. You will not receive a refund if you are refused entry due to this age restriction. When you submit a booking via our online reservation system you will receive an automatically generated booking summary by email to the email address you provide in the booking form; this does not form a contract. All bookings made online are provisional until confirmed and a contract shall only arise when your payment is received or a letter of confirmation sent by post or email. The agent has the right to refuse any booking prior to the issuing of any confirmation in writing. When you receive your confirmation you must check all the details carefully for accuracy and contact the Agent immediately if you find any discrepancy.
RENTALS AND CHARGES
To secure your booking the first nights rental will be charged on the day of booking and is non-refundable in the event of cancellation. The final balance will be due 5 days prior to your arrival and is non-refundable once paid. All payments are non-transferable. Your booking may be cancelled up to 5 days prior to arrival without any cancellation fee applying.
All debit/credit cards used to pay for deposit or final balance payments must be in the name of the person making the booking and registered to the address of that person which in turn matches the details entered on the booking form. If these details do not match then it is likely that the payment request will be not pass through our security checking and payment will be declined. We reserve the right to cancel your booking if we cannot verify your address and payment details.
CHANGES TO RESERVATIONS BY YOU
Should you wish to change your reservation once the agent has issued a confirmation to you, the agent may have to treat this as a cancellation of the booking which would then be subject to cancellation charges which may be as much as the total amount paid. The agent will advise you if this is the case and you will have the option to continue with the first reservation. Should the agent be able to transfer your booking to another property belonging to the owner there will be an administration fee of £30.
RESERVATION CANCELLATION OR ADJUSTMENT BY US
The agent hopes that it does not have to either cancel or adjust your booking in any way: however, as unforeseen problems do occur the agent would contact you immediately to discuss any proposed cancellation or adjustment. If the circumstances affect your desired property, the agent will endeavour to find you alternative and similar accommodation at a similar rental. If the alternative is unacceptable to you, or the rental more than you wish to pay, the agent will refund all of your original rental deposit. The agent will not be liable to pay compensation to the guest in event of a cancellation. Except where otherwise expressly stated in these conditions, the owner and the agent shall not be liable for changes beyond the agents control or beyond the control of the owner.
CANCELLATION BY YOU
PLEASE ENSURE THAT YOU ARE PROTECTED BY CANCELLATION INSURANCE
If you have to cancel your reservation you must contact the agent as soon as possible. The day on which the agent receives communication from you is the day on which your reservation is cancelled. Deposits and paid final balances are non-refundable in the event of a cancellation. Please note that should you cancel your booking prior to the balance due date the final balance payment this will not be due to be paid and will not be charged to your card.
The agent advises that you ensure you have cancellation insurance cover so you are protected should you cancel your booking. The agent or owner cannot be held responsible if you decide not to protect yourself for cancellation.
COMPLAINTS
The agent hopes that you will not have any cause for complaint but in the event of a problem arising, you must in the first instance contact the person detailed on your booking form and/or final payment confirmation immediately so that any problem may be speedily resolved, as the Owner must be given the opportunity to rectify the problem during your stay. Some problems are very easily rectified if notified. If, after this, you feel that the problem has not been resolved then you must, within 7 days of the end of your holiday, put your complaint in writing to the agent. All letters will be copied to the Owner for their comments and response. Please be aware that the agent can only act as a mediator in these situations to try to facilitate an outcome satisfactory to both parties.
LIABILITY
In agreeing to the booking terms you agree to indemnify the agent and owner against all losses and damage to the property and its contents, howsoever arising, including losses and damage arising as a result of any deliberate or negligent act or omission by you or any other person or animal accompanying you or any member of your party.
We do not accept responsibility for any injury or accidents caused by personal electrical equipment taken into the property.
LAW
The contract between you and the owner is subject to Scots Law.
