TERMS AND CONDITIONS FOR BRAEVELLIE LUXURY APARTMENTS

Your booking contract is between you, the guest and Malcolm Maclean & Son Ltd, T/A Braevellie Apartments, owner of the apartment. This contract is subject to the following conditions. (Nothing in these conditions affects your statutory rights).
Number of Guests
The maximum number of guests per apartment is 4. This is both a condition of our insurance and Short Term Lets licences and must not be exceeded.
Usage
Your booking should be for holiday purposes only unless otherwise agreed in writing. These properties must not be used for party purposes and it is a condition of our insurance that we cannot accept stag or hen groups.
Braevellie is situated in a quiet residential area and we politely request that you are mindful of our neighbours.
PETS
Sorry, but we do not accept pets in either apartment.
SMOKING
Both apartments operate a no smoking policy. If you wish to smoke, please do so outside and dispose of extinguished items in the bucket provided. Smoking inside the properties is a breach of our property insurance terms.
PERSONAL DETAILS
Information you provide will not be shared with any third parties.
YOUR APARTMENT
Your apartment will be available from 1600hrs on the day of your arrival and it must be vacated by 1000hrs on the day of your departure. Entry details, key collection information and/or meet and greet arrangements for your apartment will be sent to you prior to arrival as part of your payment confirmation. Please ensure you have these details prior to your arrival as if you arrive without making arrangements in advance you may not be able to gain entry to the Apartment.
You agree to keep the property clean and tidy and to leave it in a similar condition of cleanliness to when you arrived. Any additional cleaning of the property, following your departure, beyond the normal amount reasonably required, may be charged as extra. Please ensure that all your guests are aware of their responsibility to leave the apartments as they were found.
YOUR BOOKING
You must be 21 years or over when you book the apartment. The Owner or their representative, has the right to refuse you entry to the property if you are not over 21 years old. You will not receive a refund if you are refused entry due to this age restriction. When you submit a booking via our online reservation system you will receive an automatically generated booking summary by email to the email address you provide in the booking form; this does not form a contract. All bookings made online are provisional until confirmed and a contract shall only arise when your payment is received or a letter of confirmation sent by post or email. The Owner has the right to refuse any booking prior to the issuing of any confirmation in writing. When you receive your confirmation you must check all the details carefully for accuracy and contact the Owner immediately if you find any discrepancy.
RENTALS AND CHARGES
Your booking may be cancelled up to 10 days prior to arrival without any cancellation fee applying. Payment in full will be taken 10 days prior to arrival and is then non-refundable.
Our online payment system uses enhanced security checking. All debit/credit cards used to pay for deposit or final balance payments must be in the name of the person making the booking and registered to the address of that person which in turn matches the details entered on the booking form. If these details do not match then it is likely that the payment request will be not pass through our security checking and payment will be declined. We reserve the right to cancel your booking if we cannot verify your address and payment details.
CHANGES TO RESERVATIONS BY YOU
Should you wish to change your reservation once the Owner has issued a confirmation to you, the Owner may have to treat this as a cancellation of the booking which would then be subject to cancellation charges which may be as much as the total amount paid. The Owner will advise you if this is the case and you will have the option to continue with the first reservation.
RESERVATION CANCELLATION OR ADJUSTMENT BY US
The Owner hopes that it does not have to either cancel or adjust your booking in any way: however, as unforeseen problems do occur the Owner would contact you immediately to discuss any proposed cancellation or adjustment and provide a full refund as necessary. The Owner will not be liable to pay compensation to the guest in event of a cancellation. Except where otherwise expressly stated in these Conditions, the Owner shall not be liable for changes beyond the control of the Owner.
CANCELLATION BY YOU
PLEASE ENSURE THAT YOU ARE PROTECTED BY CANCELLATION INSURANCE
If you have to cancel your reservation you must contact the Owner as soon as possible. The day on which the Owner receives communication from you is the day on which your reservation is cancelled. Deposits and paid final balances are non-refundable in the event of a cancellation. Please note that should you cancel your booking prior to the balance due date the final balance payment will not be due to be paid and will not be charged to your card.
The Owner advises that you ensure you have cancellation insurance cover so you are protected should you cancel your booking. You will be offered information about cancellation cover with a third party insurer as part of our booking process. The Agent or Owner cannot be held responsible if you decide not to protect yourself for cancellation.
COMPLAINTS
The Owner hopes that you will not have any cause for complaint but in the event of a problem arising, you must in the first instance contact the person detailed on your booking form and/or final payment confirmation immediately so that any problem may be speedily resolved, as the Owner must be given the opportunity to rectify the problem. Some problems are very easily rectified if notified. If, after this, you feel that the problem has not been resolved then you must, within 7 days of the end of your holiday, put your complaint in writing to the Owner.
LIABILITY
In agreeing to the booking terms you agree to indemnify the owner against all losses and damage to the property and its contents, howsoever arising, including losses and damage arising as a result of any deliberate or negligent act or omission by you or any other person or animal accompanying you or any member of your party.
LAW
The contract between you and the Owner is subject to Scots Law.
